1. Information on how to enter this promotion and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. By entering this Kango Hammer & Mallet Pack Competition promotion ("Promotion”), you agree to these Terms and Conditions, which will at that time, become binding between you and us. 
     
  2. No salesperson, representative or agent is authorised by us to give any guarantee, warranty or representation in addition to, or contrary to these Terms and Conditions. 
     
  3. The Promoter is Techtronic Industries Australia Pty Limited (ABN 98 002 277 509) of 31 Gilby Road Mount Waverley VIC 3149 (“Promoter”). 
     
  4. Entry is only open to Australian residents aged 18 years or over. 
     
  5. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 
     
  6. The Promotion commences at 9am AEST on 16/09/24 and closes at 11:59pm AEST on 29/09/24 (“Promotional Period”). The time of entry will be deemed to be the time the entry is received by the Promoter. No entries will be accepted outside this time unless extended by the Promoter. 
     
  7. To enter, individuals must complete the following steps on any of the below platforms during the Promotional Period: 
    1. visit https://www.kangotools.com.au or locate the promotional post via Kango’s Facebook (https://www.facebook.com/KangoToolsAU) or Instagram (https://www.instagram.com/kangotools/); 
    2. follow the prompts to the competition entry form; and 
    3. input the requested details (including their first name, last name, email address, contact number, postcode and profession) and submit the fully completed entry form. 
       
  8. Only one (1) entry is permitted per person. 
     
  9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion.  
     
  10. Incomplete, indecipherable or illegal entries will be deemed invalid. 
     
  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to request identification documentation from an entrant and/or to determine the identity of the entrant. 
     
  12. This is a Game of Chance and winners will be selected by lottery. 
     
  13. There will be one draw that is conducted for this Promotion. The draw will take place at Techtronic Industries Australia Pty Limited, 31 Gilby Road Mount Waverley VIC 3149 on 4/10/24 at 10:00am AEST. The Promoter may draw additional reserve entries and record them in order, in the case that an invalid entry or ineligible entrant is drawn. The winner will be notified by email and telephone within seven (7) days of the draw and their name will be published online at https://www.kangotools.com.au/competition-winners on 11/10/24 for a period of no less than 28 days. 
     
  14. The Promoter’s decision is final and no correspondence will be entered into. 
     
  15. The first (1) valid entry drawn will win one (1) prize valued at RRP $675.76 (see details below).

  1. The winner must respond to claim the prize by 5pm AEDT on 11/10/24 if the winner fails to do so the prize will be forfeited. 
     
  2. Subject to the unclaimed prize draw clause, if for any reason the winner does not claim the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 
     
  3. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal (or greater) value and/or specification, subject to any written directions from a regulatory authority. 
     
  4. The prize will be posted by registered mail to the address provided by the winner at the time of contact from the Promoter. 
     
  5. Total number of prizes: 1.  

    Total prize pool value is RRP $675.76. 

    Any prize is valued in Australian dollars unless expressly stated to the contrary. 
     
  6. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 
     
  7. Entrants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Entrants are responsible for any and all expenses that they incur in entering the Promotion and they will not be reimbursed for doing so. 
     
  8. A draw for any unclaimed prize may take place on 15/10/24 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winner, if any, will be notified by email within seven (7) days of the draw, and their name will be published online at https://www.kangotools.com.au/competition-winners on 22/10/24. 
     
  9. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion. 
     
  10. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 
     
  11. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of electronic tampering or fraud, the Promoter may, to the fullest extent permitted by law, (a) disqualify any entrant, entry, or (b) modify, suspend, terminate or cancel the Promotion, where necessary and appropriate under the circumstances, subject to any written directions from a regulatory authority. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, subject to any written directions from a regulatory authority. The Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading, fraudulent, or not in accordance with these Terms and Conditions or who manipulates or tampers with the entry process. The Promoter may disqualify any entrant who it has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Promotion. If a winner breaches these Terms and Conditions, the winner will forfeit the prize in whole and no substitute will be offered. 
     
  12. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and related entities of the Promoter. Some of these third parties are located outside Australia and New Zealand, by entering into this Promotion an entrant is consenting to the disclosure of an entrant’s PI to entities outside of Australia and New Zealand. The Promoter will also use and handle all PI as set out in the Promoter’s Privacy Policies. In addition to any use that may be outlined in these Terms and Conditions and the Promoter’s Privacy Policies, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research, survey and profiling purposes, including sending emails/electronic messages, SMS or telephoning the entrant. The Promoter’s Privacy Policies also contain information about how entrants may opt out of any communication, access, update or correct their PI, how entrants may complain about a privacy breach or concern and how those complaints will be dealt with. All entries become the property of the Promoter.  
     
  13. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at https://www.facebook.com/terms.php and Instagram Rules, which can be found at http://instagram.com/about/legal/terms. 
     
  14. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook or Instagram.  
     
  15. The Promotion and these Terms and Conditions of entry will be governed by the laws of Victoria, Australia. Entrants accept the non-exclusive jurisdiction of courts and tribunals of Victoria, Australia in connection with the Promotion and these Terms and Conditions.
